Nuisance Claims (Public and Private)

Nuisance can be separated into either Public Nuisance or Private Nuisance. Public nuisance is where someone’s actions affect a number of people as a whole. Private nuisance is where those actions cause interference to an individuals use or enjoyment of their land. Nuisance can take many forms for example:

  • Noise
  • Smells
  • Leaks
  • Damage to your property
  • Interfering with your rights over land, such as overgrowing boundaries or access to land

There are a number of legal remedies to nuisance neighbours. These can range from claiming damages for losses you may have suffered to obtaining a Court Injunction which compels them to cease their nuisance actions.
